General terms for access and use of the services

This document sets out the general terms and conditions for access to and use of the website https://oaseeds.com (hereinafter, the “WEBSITE”) provided by OASIS ECOMMERCE SL to Internet users.

Purpose

The purpose of this WEBSITE is the sale, to adults only, of cannabis seeds exclusively as souvenirs or collectors’ items for genetic preservation.

Registered users may also subscribe to a newsletter providing information on offers, new products and industry news.

Acceptance of the general terms and conditions

By using the services and content of the WEBSITE, the user confirms and expressly accepts the terms set out in these general terms and conditions.

Statements, duties and limitations

The user declares that they are of legal age and have sufficient legal capacity to be bound by these general terms and conditions and to use the services and purchase products on this WEBSITE.

The user expressly and without exception acknowledges and accepts that access to this WEBSITE and use of its services and content are carried out freely and knowingly, under their sole responsibility.

The user undertakes to make proper use of the services and content of this WEBSITE in accordance with the law, morality, public order and these general terms and conditions.

The user also undertakes not to use these services and content for unlawful activities or activities constituting a criminal offence and/or that infringe intellectual or industrial property regulations, or any other applicable legal provisions.

Registered users must keep their account information up to date. The WEBSITE reserves the right to cancel accounts containing false, inaccurate or non-operational data.

Registered users are solely responsible for keeping their password confidential. Any activities carried out through their account are also their responsibility.

Registered users must log out when leaving this WEBSITE and must immediately report any unauthorised use of their password or account.

Materials from this WEBSITE may only be downloaded for personal use provided that copyright, trade mark and other intellectual and industrial property rights are respected.

This WEBSITE has been created in good faith by OASIS ECOMMERCE SL using information obtained legally from internal and external sources. However, OASIS ECOMMERCE SL does not guarantee the reliability, usefulness, truthfulness or accuracy of the content.

All product information is provided “as is”, for informational and educational purposes only.

This WEBSITE accepts no liability for damages of any kind arising from the use of the content, services and products by users.

This WEBSITE does not control or guarantee the absence of computer viruses in the content and accepts no liability for damages caused by computer viruses.

This website and its content are intended exclusively for persons aged 18 or over.

OASIS ECOMMERCE SL is not responsible if a user under 18 gains access by providing untruthful personal data. If it detects an account that may belong to a person under 18, it reserves the right to request proof of identity by providing a copy of a national ID document within 48 hours. This documentation must be sent to [email protected]. If the user fails to comply, OASIS ECOMMERCE SL reserves the right to cancel the account and prevent access to the WEBSITE. Likewise, if an order has been placed by a user whose account has been cancelled, OASIS ECOMMERCE SL reserves the right to cancel the order and refund the amount via the same payment method or another method agreed by both parties.

Reservation of rights

This WEBSITE reserves the right to make changes, additions and deletions to the content and services offered to users, without prior notice and unilaterally.

This WEBSITE reserves the right to amend these general terms and conditions. Any amendment or inclusion shall be subject to these general terms and conditions.

Payment methods

Credit/debit card

VISA, Mastercard or Maestro, as well as any debit card. We offer a secure payment method verified by the banking entity. During the checkout process, before entering any data, you are redirected to the bank’s website, where card details are entered and processed. In no case does this WEBSITE have access to your banking details.

Unauthorised transactions may occur if the card is not enabled for secure payments. Your bank can resolve this quickly.

Bank transfer

Payment by bank transfer may take 1 to 3 working days.

You may make a deposit or bank transfer directly to our account. Please include the order number or reference in the payment description, as well as your full name.

Once we have received payment of the total order amount (bank fees to be borne by the customer), we will notify you by email that your payment has been accepted.

For orders originating outside the Eurozone, OASIS ECOMMERCE SL reserves the right to request an additional amount equivalent to any difference arising from currency exchange, or alternatively to reduce the order contents by an equivalent value.

Prices and taxes

Product prices in the shopping basket include Value Added Tax (VAT) but do not include shipping costs. Shipping costs are calculated during the checkout process.

Purchases made by private individuals domiciled in Member States of the European Union are subject to VAT in accordance with the applicable regulations.

Purchases made by natural or legal persons resident in countries outside the European Union may be exempt from VAT in accordance with the applicable regulations.

Typographical or manifest errors in prices and availability

OASIS ECOMMERCE SL endeavours to ensure that the prices, descriptions and availability displayed on the WEBSITE are correct. However, if a manifest and verifiable error occurs (for example, a typographical error showing a clearly incorrect price), OASIS ECOMMERCE SL reserves the right to cancel the affected order and issue a full refund of any amounts paid.

In such cases, the customer will be informed as soon as possible and, where feasible, will be offered the option to reconfirm the order at the correct price or under the correct conditions.

Shipping

Home delivery:

Mainland Spain: delivery time 24–48 hours (excluding public holidays).
Balearic Islands: delivery within 48–72 hours (excluding public holidays).
EU countries: delivery within 3–5 working days.
Rest of the world: delivery within 10–15 working days depending on the destination.

If we are unable to meet the delivery timeframe, OASIS ECOMMERCE SL will inform customers of the reason for the delay and propose alternative solutions where possible.

Once payment has been received, we will send an email with the shipment/tracking number for online tracking. For orders received on Friday, Saturday or Sunday, the tracking number will be sent between Monday and Tuesday.

OASIS ECOMMERCE SL accepts no responsibility for delays caused by customs services in the destination or transit countries.

OASIS ECOMMERCE SL shall not be liable under any circumstances for shipments seized by Customs or similar authorities. The customer is responsible for informing themselves about the applicable regulations in their country and for assuming any risks associated with importation, where applicable.

Returns

In the event of an error or issue upon delivery, you have 72 hours from receipt of the order to submit the relevant claim by emailing [email protected]. After this period, receipt of the goods shall be deemed satisfactory, unless proven otherwise.

The customer may exercise the right of withdrawal within 14 calendar days from receipt of the order by emailing [email protected] or by completing the withdrawal form available on the WEBSITE.

Once the request is received, we will provide instructions to complete the return. The product must be returned in suitable condition, together with a copy of the delivery note or simplified invoice.

For international shipments, the tracking number assigned by the carrier must also be provided where applicable.

Returns of unsealed or opened products will not be accepted where, due to their nature, it is not possible to verify their integrity or where opening may affect their resale, without prejudice to any statutory rights of the consumer under applicable law.

OASIS ECOMMERCE SL will refund the amount received using the same payment method used by the customer, unless expressly agreed otherwise, within the legally applicable timeframe from the date the customer informed us of their decision to withdraw, provided that the product has been returned in accordance with the instructions given.

The customer may also request a voucher for the same amount as the purchase, redeemable within 6 months of receipt.

Seed returns: specific provisions

Cannabis Sativa seeds may only be germinated in certain countries where permitted or under the conditions authorised by law. The customer is responsible for informing themselves about their country’s laws and acting accordingly.

Claims for non-germinating seeds will be accepted provided that the seed bank accepts the return and we receive the claim form duly completed. The original packaging must be kept for any claim.

Claims will not be accepted for seeds from the Gifts section or seeds sent as samples or freebies.

Claims will not be accepted where the quantity concerned is less than or equal to 20% of the contents of the pack.

Promotions and commercial offers

Oaseeds may occasionally offer promotions, special offers, prize draws, gifts or other commercial actions (hereinafter, the “Promotions”), which may be subject to specific conditions in addition to these General Terms and Conditions.

Participation in any Promotion implies acceptance of its specific conditions, as well as these General Terms and Conditions and our Privacy Policy. In the event of a conflict between the conditions of a specific Promotion and these General Terms and Conditions, the specific Promotion conditions shall prevail.

General conditions applicable to promotions

All promotions and offers are temporary and may be modified, suspended or cancelled at any time without prior notice, unless expressly stated otherwise.
Promotions cannot be combined with other promotions, offers, discounts or coupons, unless explicitly stated.
Promotions linked to a minimum purchase amount apply exclusively to individual orders. Amounts from multiple orders cannot be combined to reach the required minimum.
Unless otherwise stated, only one coupon or promotional code may be used per order.
Where promotions include free products, free seeds or other benefits associated with an order, if the customer requests a full or partial return/refund, all promotional items must also be returned in order to receive a full refund. Otherwise, any benefits obtained will be withdrawn or deducted from the refund amount.
Promotions are not redeemable for cash or other products, unless expressly stated.
Oaseeds reserves the right to cancel or refuse the application of a promotion in cases of fraudulent use, abuse, a manifest system error, or non-compliance with the published conditions.

Calculation of the minimum purchase amount for promotions

For promotions that require a minimum purchase amount to apply, the calculation will be made according to the following criteria:

Only products in the basket will be taken into account, including applicable taxes (VAT).
Shipping costs will not be included under any circumstances.
Other additional costs, such as surcharges or extra services, will not be included.
Discounts applied via coupons will be taken into account, meaning the minimum amount must be reached after discounts have been applied, if any.

Example:

If a promotion requires a minimum purchase of €50, the basket must reach €50 in products including VAT, after applying any discount coupons, and excluding shipping costs.

Promotions are applied automatically when the stated requirements are met. If a promotion is not shown in the basket before confirming the order, it means that the required conditions have not been met. The valid amount will be the one shown in the basket summary immediately before confirming the order.

Guarantees

In accordance with applicable regulations, products of a durable nature that are not subject to expiry are covered by the statutory warranty period.

For products that include an expiry date or best-before date, the warranty will apply until the stated date, within the maximum period established by applicable law.

After the first 6 months and until the end of the statutory period, verification of the product may be required to determine whether the fault is inherent or due to misuse, in accordance with applicable regulations.

The warranty does not cover products damaged due to knocks, negligence or improper handling, nor items worn through normal use.

If replacement is necessary, it will not extend the warranty period and the same terms will apply as for the original product.

On the sale of cannabis seeds

The 1961 Single Convention on Narcotic Drugs, as amended by the 1972 Protocol and ratified by the Spanish State, provides for the control of certain parts of the cannabis plant, but expressly excludes seeds.

In Spain, the sale of seeds is not a criminal offence provided that cultivation is not intended for trafficking. OASIS ECOMMERCE SL only sells cannabis seeds for personal cultivation in countries where such cultivation is not a criminal offence, or for study or collecting purposes.

Users are responsible for knowing the laws in force in their country of residence regarding cannabis.

OASIS ECOMMERCE SL does not wish to induce anyone to act against the law in any country.

OASIS ECOMMERCE SL refuses to sell cannabis seeds to anyone for whom it has reason to believe that they will cultivate in a country where cultivation is illegal.

The user undertakes not to use the services and content of the WEBSITE for unlawful activities or activities constituting a criminal offence and/or that infringe intellectual or industrial property regulations, or any other applicable legal provisions.

OASIS ECOMMERCE SL accepts no liability arising from misuse of the seeds it sells.

OASIS ECOMMERCE SL is not responsible for illegal uses that third parties may make of our products.

OASIS ECOMMERCE SL encourages users to act responsibly.

Applicable law, jurisdiction and online dispute resolution

These general terms and conditions are governed by the laws in force in Spain.

Any dispute shall be submitted to the courts and tribunals that are competent under applicable law. In the case of consumers, the competent court shall be the court of the consumer’s domicile or as otherwise determined by the applicable regulations.
